Philadelphias First Source Job Policy

On November 13th, Mayor Michael Nutter signed into law Bill No. 120009, which amends Title 17 of the Philadelphia code entitled Contracts and Procurement by adding a new chapter entitled First Source Job Policy. The First Source Job Policy creates a registry of City residents for the purpose of employment referral and further requiring that beneficiaries of City financial assistance use the registry for all hiring relating to any new, entry-level job created as result of financial assistance. A city agency or department has not been designated by the Mayors office to implement and enforce the First Source Job Policy yet.

A beneficiary of City financial assistance is defined as any private party, including both for profit or non profit organization that is the direct recipient of City financial assistance. Entry level jobs will be defined as work that requires little or no formal vocational training, education, or prior experience in the field or profession beyond on-the-job training. Only entry level jobs that are created directly or indirectly from city financial assistance will be subject to regulations under the First Source Job Policy amendment.

Financial assistance includes any grant, loan, tax incentives, bond financing, subsidy for land purchase, or any other form of assistance in the amount of twenty five thousand dollars ($25,000) or more from any city agency. Examples include, but are not limited to, tax increment financing, industrial development bonds, use of the power of eminent domain, community development block grants or loans, airport revenue bonds, and Enterprise Zone or other similar economic development designations.

A First Source Employment agreement between the City and a financial beneficiary will mandate that the Beneficiary must make a good faith effort to fill all new, entry level jobs created directly or indirectly as a result of Financial Assistance with candidates from the first source candidate registry. Beneficiaries must notify the eventually designated department of all new entry-level job openings. The Beneficiary must make a good faith effort to hire from the first source registry, but if the vacancy is not filled within ten (10) days, the beneficiary is free to fill the entry-level job from other sources.

If the Designated Department determines that a Beneficiary has not complied with the First Source Job-Policy provisions, it can recommend that the City implement the following punishments.

1. Withhold financial assistance payments pending corrective action
2. Require reimbursement of an appropriate amount of the Financial Assistance already provided to the Beneficiary.
3. Suspend a Beneficiary from bidding on or participating in future City contracts for up to three (3) years.

The First Source Job Policy provisions will become effective in May 2013.
